The following definitions shall have the same meaning regardless of whether they appear in the singular or plural form, regardless of their capitalization, or whether they are preceded by the definite article "the" or not.
"App" refers to the Symbols mobile application; both the mobile application for iOS and the mobile application for Android by that name. When we use the word "App", we are referring to the application that we designed to help users learn, review, or practice their logical reasoning skills, regardless of the platform that we have currently created the "App" on or will create in the future. It may interchangeably be called "application", "app", "Symbols", "product", or "service".
"Website" refers to the Symbols website, which is used to help users gain more information about us and our services and products, and so that users can decide whether or not they want to try our App. It is currently located on (https://www.symbols-app.com) but in the future may have a different address.
"the Company" refers to Rayes Apps, and may interchangeably be referred to as "us", "we", or "our".
"User" refers to the end user and interchangeably referred to as "you" or "your".
"Device" means any device that can access our App or Website, such as a smart phone or a digital tablet.
"Account" an account that is created by us for the user to grant them varying access to our product. It is currently based on the email of the user, but we reserve the right to use other parameters in the future and may do so if a more efficient method for either us or the end-user is found.
"Symbols Activity" an activity found within the App that is designed to help users learn, review, or practice their logical reasoning skills. The number of activities found in the App may change in the future, and we hope to offer more as time goes on. It may interchangeably be referred to as "activity".
"Symbols Studycard" a type of study material that is found within the App, designed to help users learn, review, or practice their logical reasoning skills. The number of Studycards may change in the future, and we hope to offer more as time goes on. It may interchangeably be referred to as "Studycard".
"Symbols Cycle" a process that involves switching between Activities and Studycards, so that users may take in information using Studycards and practice what they have recently learned using an activity.
"Paid subscriptions" a premium version of our app (that unlocks more features) that a user can purchase from our product in exchange for the payment of a fee.
"Store" refers to the entity from which users purchase paid subscriptions from. Currently, this is either the Apple App Store or Google Play Store.
As an express condition of your access and use of our App or Website, you represent and warrant that:
You will only use your own email and password to access our products or services.
You will not share your login information with anyone else, or endanger the security of your account.
You will not assist anyone in gaining unlawful access to our products or services, or assist them in gaining illegal access to paid material.
You will not commit any crimes, break any laws, abuse or harass fellow users or post content that is abusive or otherwise insensitive to anyone or any particular group while using our App or Website.
You will be responsible for any information that you upload, share, post, or transmit to or through our App or Website.
If you purchase or plan to purchase a paid subscription with us, you will familiarize yourself with the payment and cancelation policies of the respective store from where you plan to purchase the paid subscription. You should understand how to cancel or terminate a paid subscription before you purchase one from or through any app, including ours.
Both our website and our mobile applications are owned by Rayes Apps. Both the app and the website are protected by the applicable copyright and trademark law, including, but not limited to, the artwork, content, features, logos, graphics, as well as Symbol Activities, Symbol Studycards, and other information or features found within our app or website.
You agree to use the app, the website, and any Activity or Studycard found therein, in the way that they are intended to be used and within the scope of your account:
This means that you may NOT modify, disassemble, decrypt, extract, or otherwise reverse engineer any part of our app or website, or create derivative works based upon all or part of their content and features.
It also means that you may NOT access or attempt to access any material that is not warranted by your account. For example, if you do not have a paid subscription at the time of using our app, you may not access certain content that is only provided to users with a paid subscription.
Furthermore, in the event that you share any part of our content in any form, you agree to give us credit by providing the address to our website or linking to our app and the respective store(s) in which the app may be downloaded.
As our services grow and as the Symbols app becomes more mature, we reserve the right to change any part of this document for any reason and at our sole discretion. We will attempt to notify the user of any such changes through our app, website, or by notifying the user via email.
It is the responsibility of the user to check for any changes and be aware of this possibility even in the event that we fail to notify them.
ALL CONTENT AND FEATURES PROVIDED ON OUR SERVICE, WEBSITE, OR APPLICATION IS PROVIDED ON AN “AS IS”, “AS AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO, ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR ANY PARTICULAR SERVICE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR APPLICATION, WEBSITE, OR SERVICE WILL ALWAYS BE AVAILABLE, THAT ACCESS WILL NEVER BE INTERRUPTED, THAT THEY WILL ALWAYS BE FREE OF ERRORS, EXCEPTIONS, OR PROBLEMS, OR THAT ANY DEFECTS IN OUR SERVICE, APPLICATION, OR WEBSITE WILL BE READILY CORRECTED.
INFORMATION ON OUR SERVICE, APPLICATION, OR WEBSITE SHOULD NOT NECESSARILY BE RELIED UPON AND SHOULD NEVER BE CONSTRUED TO BE PROFESSIONAL ADVICE FROM US IN ANY MANNER. WE DO NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF ANY PIECE OF INFORMATION PROVIDED, AND ARE NOT RESPONSIBLE FOR ANY LOSS OR DAMAGES RESULTING FROM YOUR RELIANCE ON SUCH INFORMATION.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY OF THE FOLLOWING BUT NOT SOLELY LIMITED TO THE FOLLOWING: (I) THE USE OR THE INABILITY TO USE OUR APPLICATION, WEBSITE, OR SERVICE; (II) ANY ERRORS, MISTAKES, OR INACCURACIES ON ANY CONTENT OR FEATURE IN OR ON THE APPLICATION, WEBSITE, OR SERVICE; (III) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY KIND WHATSOEVER, RESULTING FROM YOUR ACCESS TO, USE OF, OR INABILITY TO USE OUR APPLICATION, WEBSITE, OR SERVICE; (IV) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR APPLICATION, WEBSITE, SERVERS, CLOUD PROVIDERS, DATABASES, OR ANY OTHER DEPENDENCY THAT OUR APPLICATION OR WEBSITE RELY ON IN ANYWAY, THAT RESULTS IN THE LOSS OR SPREAD OF ANY OF YOUR DATA; OR SHOULD YOUR DATA BE COMPROMISED BY THIRD-PARTIES, ILLICIT OR OTHERWISE, FROM THE DIRECT OR INDIRECT USE OR ACCESS TO OUR APPLICATION, WEBSITE, OR ANY NETWORK OR SERVICE ASSOCIATED WITH OUR APPLICATION, WEBSITE, OR SERVICE, OR IF YOU ARE DECEIVED BY ILLICIT THIRD-PARTIES INTO BELIEVING YOU ARE USING OUR APPLICATION OR WEBSITE AS IS COMMON IN PHISHING OR OTHER TYPES OF ATTACKS; (V) THE COST TO PROCURE A SUBSTITUTE GOOD OR SERVICE FOR ANY REASON WHATSOEVER DUE TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE OUR APPLICATION, WEBSITE, OR SERVICE; (VI) ANY LOSS OF DATA FOR ANY REASON WHATSOEVER; YOU UNDERSTAND THAT OUR SERVERS, DATABASES, OR CLOUD PROVIDERS AND OUR USE OF THEM ARE ALL SUSCEPTIBLE TO PROBLEMS AS IS THE VERY NATURE OF SOFTWARE OR PRODUCTS AND SERVICES OVER THE INTERNET. (VII) ANY SECURITY VULNERABILITIES OR ILLICIT ACTIVITY THAT MAY OCCUR ON THE INTERNET. FURTHERMORE, IF YOU HAVE DOWNLOADED OUR APPLICATION FROM AN ILLEGAL OR ILLICIT THIRD-PARTY PROVIDER, THAT MAY HAVE MODIFIED, REVERSE-ENGINEERED, OR TAMPERED WITH THE APPLICATION IN ANYWAY, THEN WE BEAR ABSOLUTELY NO RESPONSIBILITY AS WE HAVE MADE OUR APPLICATION SOLELY AVAILABLE ON THE RESPECTED STORES LISTED IN THE DEFINITION SECTION OF THESE TERMS.
DESPITE THE ABOVE, OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE OF ACTION YOU TAKE AGAINST US WILL AT ALL TIMES BE LIMITED TO NO MORE THAN SIX MONTHS OF THE PAID FEES ASSOCIATED WITH YOUR ACCOUNT WITH US OR ONE-HUNDRED DOLLARS ($100.00), WHICHEVER OF THE TWO SUMS IS THE LESSER SUM.
Some countries and jurisdictions do not allow the limitation or exclusion of certain damages in contracts with consumers, and so, to the extent that you are a consumer some limitations or exclusions in this section may not apply to you.
With paid subscriptions, users gain access to more features of the app or can access features that would otherwise be locked to users without a paid subscription.
Paid subscriptions are made available to users in exchange for a fee.
The fee is paid by the user using either the Apple App Store (for users on iOS) or the Google Play Store (for users on Android).
Each paid subscription comes with a duration in time for which the additional access is granted to the user. For example, a monthly subscription grants the user additional access and more features for the duration of a month.
Unless otherwise stated by the store that offers the purchase, paid subscriptions are "auto-renewed", which means that at the end of their duration, the subscription is automatically renewed and the agreed upon fee is automatically withdrawn from the user or charged to the user by the Apple App Store or Google Play Store. Unless otherwise stated by the offering store, paid subscriptions "auto-renew" until they are canceled or terminated by the user. For information on how to cancel a paid subscription, please see the "Termination or Cancellation of Paid Subscriptions" section.
All purchases of paid subscriptions are final and non-refundable. We encourage users to use as many of the free features as is available to them so that they may make an informed decision about whether or not to purchase a paid subscription.
All purchases, including paid subscriptions, purchased through the Apple Apple Store or Google Play Store can be managed through the account that you have with the respective store. You can manage your paid subscriptions and cancel or terminate any of them.
If you cancel or terminate any paid subscription, it will remain active until the end of your subscription period (duration), and will simply not be renewed in the next billing cycle.
Please understand that you must cancel or terminate a paid subscription when you no longer wish to use or pay for the service. It is not sufficient to uninstall the app or delete your account with us. This is because the paid subscription can only be purchased through an offering store (the Apple App Store or the Google Play Store), and so, must be canceled through the respective store(s) from which you purchased the paid subscription from.

Disclaimer: Before purchasing a paid subscription, it is the responsibility of the user to to be familiar with the policies and processes of the respective store from where they wish to make the purchase of a paid subscription. We are not a part of the Apple App Store or the Google Play Store, so after a user has made a purchase using either store, all matters pertaining to said purchase are between the user and the respective store or stores. So, if a user wishes to cancel or terminate a paid subscription or paid subscriptions, they must do so through their account with the respective store or stores from which they made the purchase or purchases.
Since we are not a part of the Apple App Store or the Google Play Store, we have no control over their policies, and since their policies are subject to change in accordance with their wishes, we cannot list them in this section. Furthermore, the methods that these stores use for canceling or terminating paid subscriptions may themselves change. For that reason, we have provided the user with the links on how to cancel a paid subscription from either store as they are in the present. If, for whatever reason in the future, any link has been moved or is otherwise unavailable and we do not update the broken link, it is the responsibility of the user nonetheless to find these resources and to become familiar with them.
We reserve the right to change our fees and prices for paid subscriptions or any other product or service at any time.
We will give you a reasonable notice about any price change through our App, Website, or by notifying you via email.
If you find the new price disagreeable, you may choose to cancel your paid subscription before the price change goes into effect.
At Symbols, we respect the privacy of our users. Please see our Privacy Policy. By using our service, you consent to our collection and use of personal data as outlined therein.
We reserve the right to delete any user account (and any of its corresponding data) and will do so at our sole discretion, for any reason, including but not limited to:
If a user wishes to terminate their account with us, they may do so by deleting their account. This can be done through the app using the "Delete My Account" button in the Settings page.
As mentioned in the "Payment Policy" section of these terms, please remember that the deletion or termination of your account with us, whether it is initiated by you or done by us, is insufficient in canceling any paid subscriptions that you may have with us in either the Apple App Store or the Google Play Store. Since paid subscriptions are entered into by the user and one or both of the respective store(s), they must be canceled by the user through their account with the relevant store(s).
This should not be a problem since both stores make it very easy for the user to manage and cancel any paid subscription.
Governing Law: Any claim relating to our service shall be governed by the laws of the State of California without regard to its conflict of law provisions.
No Implied Waiver: Failure to insist upon or enforce strict performance of any provision of these terms shall not be construed as a waiver of any provision or right.
Severability: The provisions of these terms are severable. In the event that any court of competent jurisdiction determines that any provision is invalid or unenforceable, such validity and unenforceability shall not in any way affect the validity or unenforceability of the remaining provisions.
Refunds: All sales are final and non-refundable. We encourage use of any trials or free features before any purchase.
